Flourish Terms and Conditions of Use 

By using the Flourish Creativity & Wellness Studio ("Flourish") website, completing registration for Flourish programs, and/or participating in a Flourish program, you agree to the terms below. Flourish reserves the right to modify programs, scheduling, policies, or website content at any time. Participants may be asked at time of programming to sign physical documents related to the Terms and Conditions and/or Media Permission and Release documentation.

Payments & Bookings
Full payment for attendance at workshops and programs is required prior to participation, and registration may be closed at any time. Workshop registration is confirmed once payment is received. Registration payment is non-refundable; please contact Flourish directly if there are extenuating circumstances. We understand life happens. If an emergency prevents attendance, please reach out. We will always try to respond with fairness and care when possible.

Services will be considered to have been rendered once the workshop, event, or session has been held, regardless of individual's attendance. If a workshop is cancelled or rescheduled for any reason, participants will be contacted to arrange for alternate date(s) and/or refunds, at the discretion of Flourish. Flourish reserves the right to offer either replacement dates or credit for future programs. No refunds will be provided after the workshop date. Individuals should first contact Flourish directly at flourishcreativityandwellness@gmail.com or 508.858.5758 to discuss payment issues. By placing an order, you agree to our refund policy. If you have an issue with your purchase, you agree to contact Flourish first to resolve the matter. You agree that initiating a chargeback with your bank for a transaction that was authorized and delivered according to our policies constitutes a violation of this agreement, and we reserve the right to dispute such chargebacks, suspend or remove your account, and/or pursue legal remedy if necessary. 

Private or custom program offerings will require 50% non-refundable deposit within 48 hours of receipt of invoice in order for booking being finalised. The balance to be paid no later than fourteen (14) calendar days prior to the scheduled event. If the booking is created less than fourteen (14) calendar days prior to the event, 100% non-refundable payment will be required within 24 hours of invoicing to proceed. All details regarding payment will be included in the final contract/invoice(s) for private and custom designed services.

Disclaimer of Services

Flourish Creativity & Wellness Studio programs provide guided creative experiences. These services are educational and experiential. They are not medical, psychological, or therapeutic diagnosis or treatment. Flourish, its owner, presenters, program host representatives, or other associated representatives do not provide diagnosis, treatment, or counseling services for any physical, emotional, or mental condition; participants should seek care from certified medical or therapeutic personnel if needed, or call 9-1-1 in cases of medical emergency.

 

Participation is intended for personal enjoyment, enrichment, stress relief, and creative exploration. No specific personal outcomes or experiences are expected or guaranteed. All participation is voluntary. Participants are responsible for self monitoring and respecting personal limits during all activities. Participants may choose to not perform any part of any workshop, program, or activity at any time.

Intellectual Property and Media Permissions
All Flourish workshop materials, lesson structures, written content, and creative frameworks are the property of Jennifer Cummings/ DBA Flourish Creativity & Wellness Studio. Materials may not be reproduced, copied, distributed, or used for personal or commercial purposes without written permission. For the safety and privacy of all participants, recording of workshops by Participants is not permitted for any use. To the extent allowable by law, all intellectual property created, developed, or reduced to practice by Flourish, its owner, and its representatives,  even if AI tools were utilized in the creation process, shall be owned exclusively by Jennifer Cummings/ DBA Flourish Creativity & Wellness Studio.

Photos or video may be taken by Flourish representative(s) for purposes of media and advertising during sessions at any time and will be used only with the express consent of attendees in print and/or social media. Participants may be asked for written and/or verbal permission during workshops regarding media use by Flourish.

Liability
Flourish makes reasonable efforts to provide safe and respectful creative environments. Participation involves the use of art materials and shared space. By participating, you acknowledge that minor accidents or material-related incidents may occur. Jennnifer Cummings and any representative(s) of Flourish are not responsible for personal injury, lost items, or incidental damage resulting from normal workshop activity and art materials, including, but not limited to, staining or damage to clothing, footwear, or any other personal belongings. Participants assume responsibility for their own well-being at all times while participating in Flourish programming. Flourish, its owner and/or representatives have no liability for any injury, loss, or harm that may be incurred during Flourish programming at host sites; venues are responsible for the physical location, equipment, and accommodations for participants.

Assumption of Risk
The Participant understands that participating in an art workshop may involve risks, including but not limited to, the use of art materials, tools, equipment (e.g., scissors, craft knives, cutting tools paints, solvents and related items), and potential exposure to allergic materials. The Participant voluntarily assumes all risks associated with participation, including travel to and from the workshop.

Release and Hold Harmless
In consideration of being permitted to participate in the workshop, the Participant hereby releases, waives, and discharges the Organizer, its employees, volunteers, agents, and the venue owner from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death arising out of or related to the workshop, even if caused by the negligence of the Organizer. The Participant agrees to indemnify and hold harmless the Jennifer Cummings, and/or any Flourish representative(s), and/or Program Organizer from any loss, liability, damage, or costs (including legal fees) that they may incur due to the Participant’s actions, omissions, or injuries sustained during the workshop.

Privacy Policy
Flourish respects your privacy.
We collect only the information necessary to communicate with you or provide services. This may include your name, email address, and booking details.
We do not sell or share your personal information.
Information may be used to:
• respond to inquiries
• process bookings
• send workshop updates
• provide optional newsletters
You may unsubscribe from communication at any time.
Basic website analytics may be used to understand traffic patterns. No personal identity is tracked beyond standard analytics tools.

Accessibility Statements

Physical Accessibility
Flourish is committed to creating welcoming and inclusive spaces.
We encourage participants to share accessibility needs in advance so we can support a comfortable experience. All effort will be made to accommodate the needs of participants to the level possible. Participants are not required to participate in any specific workshop or program elements they are not comfortable with at any time. All programs are designed to offer services in a welcoming and positive environment. Participants may be asked to silence their personal electronics during programming or exit the workspace for personal conversations. Participants who are observed not being respectful of the presenter(s), program host(s), or other participants through words or deeds may be asked to leave at any time at the discretion of Flourish representatives or host site representatives, and refunds will not be provided. Creative practice belongs to everyone, and Flourish works to maintain safe and supportive spaces for all.

Online Accessibility
Flourish works to ensure that all individuals are able to fully access information provided by the website, regardless of disability. To that end, Flourish is working to include descriptive alternate text for all graphic images on the site. Flourish also works with the webhost service provider to monitor and correct accessibility concerns in an expedient manner as possible.

 

Host Space Disclaimer
Flourish makes reasonable efforts to protect venue surfaces and property.
Due to the nature of creative materials, minor stains or marks may occur during normal workshop activity. By hosting a workshop, the host venue acknowledges this possibility. Flourish and its owner or representatives are not liable for incidental marks, items lost or broken by participants, or material-related damage resulting from standard creative use.

 

Flourish and/or its owner or representatives are not responsible for any failure of the physical plant, operations, or equipment under the ownership and/ or control of the host site, including, but not limited to: any damages, damages to personal property, or personal injury of program participants and/ or other Flourish customers or representatives, caused by or from use of the property, failures in host protocols or operations, and/or equipment of the host site.
